Suess Trust under Agreement dated May 31, 2016 IT IS HEREBY ORDERED AND NOTICE IS GIVEN that a Petition by Alan Winston Suess, dated January 17, 2017, has been filed with the Court. The Petition requests an order for the following relief: 1. Determining that Petitioner is the sole beneficiary of the Trust. 2. Determining Petitioner's rights to income and principal of the Trust. 3. To appoint a Successor Trustee pursuant to Minn. Stat. §501C.0704, namely First Fiduciary Corporation 4. Approving payment from the Trust of the Petitioner's reasonable attorney's fees in connection with this proceeding. 5. Approving payment from the Trust of the Petitioner's expenses incurred in connection with this proceeding. 6. Granting such other relief as may be proper. Any objections to the Petition must be filed with the Court prior to the hearing. If no objections are filed the Petition may be granted. IT IS HEREBY ORDRED THAT the Petition will be heard on March 1, 2017 at 2:00pm by this Court at the Hennepin County Government Center, C-400, 300 South Street, 55487. 1. Notice shall be given to all interested persons in the trust. 2. Pursuant to Minn. Stat. §501C.0203, Subd. 1, Notice of the judicial proceeding must be given by an interested person as follows: (1) by publishing, at least 20 days before the date of the hearing, a copy of the order for hearing one time in a legal newspaper for the county in which the petition is filed; and (2) by mailing, at least 15 days before the date of the hearing, a copy of the order for hearing to those current trustees and qualified beneficiaries of the trust whose identity is known and whose location is known or reasonably ascertainable to the petitioner after making reasonable efforts to locate such persons.
